These Terms are governed by the laws of the United States and the State of California. If you do not agree to these Terms, please do not use our services.
1. Nature of Services
Personal Health Insights provides home-based healthcare coordination, wellness consultation, and allied health services across the United States. Our services are delivered by licensed and credentialed professionals and are intended to complement, not replace, advice from your primary care physician or specialist. Nothing on this platform constitutes a formal medical diagnosis or treatment plan unless explicitly delivered by a licensed U.S.-based provider within an established care relationship.
2. Eligibility
Services are available to adults aged 18 and above who are located within the United States. Minors may receive services only with the written consent of a parent or legal guardian, and only where permitted under applicable state law. By using our services, you represent that you meet all applicable eligibility requirements and that the information you provide is accurate and complete.
3. Appointments and Cancellations
All appointments must be scheduled in advance through our platform or by contacting our care coordination team. Cancellations require a minimum of 24 hours' advance notice to avoid a cancellation fee. Repeated no-shows or late cancellations may result in suspension of service access. We reserve the right to reschedule appointments due to caregiver availability, inclement weather, or other circumstances beyond our control. We will provide advance notice whenever reasonably possible.
4. Payment, Billing, and Insurance
Service fees are disclosed at the time of booking. Payment is due at the time of service unless alternative arrangements have been confirmed in writing. We accept major credit and debit cards, Health Savings Accounts (HSA), Flexible Spending Accounts (FSA), and select private insurance plans. Insurance coverage is subject to your policy terms and the discretion of your insurer; any balance not covered by your plan is your sole financial responsibility. We do not currently accept Medicare or Medicaid. Returned payments are subject to applicable processing fees.
5. Client Responsibilities
Clients are expected to provide complete, accurate, and up-to-date health and contact information; maintain a safe, accessible, and respectful environment for visiting caregivers; treat all staff members with dignity and professionalism; promptly inform us of any changes in health status, living situation, or emergency contact information that may affect care delivery; and comply with all scheduled care protocols as agreed during your care plan consultation.
6. HIPAA Authorization
By engaging our services, you authorize Personal Health Insights to collect, use, and share your Protected Health Information (PHI) as necessary to deliver care, submit insurance claims, and comply with applicable U.S. federal and state law. You have the right to revoke this authorization in writing at any time, except to the extent that actions have already been taken in reliance on it. A revocation will not affect care already provided.
7. Limitation of Liability
To the fullest extent permitted by applicable U.S. law, Personal Health Insights shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our services or platform. Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.
8. Intellectual Property
All content on this website, including text, images, graphics, logos, care program materials, and proprietary methodologies, is the exclusive property of Personal Health Insights or its licensors and is protected by U.S. copyright, trademark, and other applicable intellectual property laws. Reproduction, modification, distribution, or commercial use of any content without prior written consent is strictly prohibited.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles, California, under its Consumer Arbitration Rules. Each party shall bear its own arbitration costs unless the arbitrator determines otherwise. Class action lawsuits are waived to the extent permitted by law.
10. Non-Discrimination Policy
Personal Health Insights does not discriminate in the provision of services on the basis of race, color, national origin, age, disability, or sex, in compliance with applicable federal civil rights laws including Section 1557 of the Affordable Care Act, the Age Discrimination Act, and Section 504 of the Rehabilitation Act. If you believe you have been subject to discrimination, you may file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights.
11. Amendments
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. For material changes, we will provide at least 30 days' advance notice via email where required by law. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
